Enacted in the Port of Pec\u00e9m, Cear\u00e1, it created the first national legal framework for low-carbon hydrogen and assigned to the National Agency of Petroleum, Natural Gas and Biofuels the authority to authorize, regulate and oversee the entire chain: production, transportation, import, export and commercialization.<\/p>\n\n\n\n<p>After this period, the sector has concrete reasons to celebrate and also objective reasons to demand more agility from the government. The question guiding this text is straightforward: what has already been implemented and what still depends on sub-legal regulation to become a reality?<\/p>\n\n\n\n<div style=\"height:50px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\">What is already standing<\/h3>\n\n\n\n<p>Three pillars were created with the law and are already operating, at least at the institutional level:<\/p>\n\n\n\n<ul style=\"line-height:1.8\" class=\"wp-block-list\">\n<li class=\"translation-block\"><strong>Rehidro<\/strong>: Special Incentive Regime for Low Carbon Hydrogen Production, which suspends the collection of PIS\/Cofins taxes for five years starting in 2025 for companies in the sector.<\/li>\n\n\n\n<li class=\"translation-block\"><strong>SBCH\u00b2<\/strong>: Brazilian Hydrogen Certification System, which establishes its own methodology to certify the intensity of greenhouse gas emissions throughout the product's life cycle, with an initial ceiling of 7 kgCO2eq per kg of hydrogen, to be gradually reduced until 2030.<\/li>\n\n\n\n<li class=\"translation-block\"><strong>PHBC<\/strong>: Low Carbon Hydrogen Development Program, sanctioned in September 2024 by Law 14.990, which provides for R$ 18.3 billion in tax credits between 2028 and 2032 for producers and buyers.<\/li>\n<\/ul>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>This set of measures gave Brazil something it lacked until 2024: a common regulatory vocabulary. International investors now have clear parameters regarding who regulates what, how voluntary certification works, and what tax incentives exist. This is no small feat, especially in a market that competes for capital with Europe, the Middle East, and Asia.<\/p>\n\n\n\n<div style=\"height:50px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\">What is still hindering progress?<\/h3>\n\n\n\n<p>The problem is that a law that has been enacted is not a law in full force. For Rehidro, SBCH\u00b2, and PHBC to function in practice, the regulatory decree that ANP and the Executive Branch need to publish is still lacking. Without it, the following remain pending:<\/p>\n\n\n\n<ol style=\"line-height:1.8\" class=\"wp-block-list\">\n<li>The definitive criteria for carbon accounting throughout the hydrogen life cycle.<\/li>\n\n\n\n<li>The legal framework for so-called \"natural hydrogen,\" included for the first time in Brazilian legislation, still lacks a clear definition regarding whether it requires authorization, permitting, or concession.<\/li>\n\n\n\n<li>The rules regarding potential local content, which the government indicates will be flexible and modulated by the National Energy Policy Council according to the technological production route.<\/li>\n\n\n\n<li>Eligibility requirements for accessing PHBC tax credits include a minimum investment in research and development.<\/li>\n<\/ol>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>Companies with advanced projects are experiencing this bottleneck firsthand. One example is Atlas Agro, which plans a nitrogen fertilizer plant in Uberaba, with an investment of R$ 4.3 billion, and depends on the decree to access the tax incentives to which it is theoretically already entitled. In 2024, the Ministry of Mines and Energy registered R$ 212 billion in filed projects, most of them concentrated in Cear\u00e1 and Piau\u00ed. Many remain in limbo.<\/p>\n\n\n\n<p>The Brazilian Green Hydrogen Industry Association has made this demand an explicit priority in its 2026 Strategic Agenda, warning that tax benefits have an expiration date and that delays in regulation are putting pressure on the timeline for companies' final investment decisions.<\/p>\n\n\n\n<div style=\"height:50px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\">What should the decree resolve?<\/h3>\n\n\n\n<p>Throughout the first half of 2026, indications from the government itself suggested that the text will maintain a principle of technological neutrality, avoiding rigidifying production routes that are still maturing, and will leave the design of any auctions for access to incentives to specific calls for proposals, outside the decree. The expectation is that laws 14.948 and 14.990 will be regulated in a joint act, consolidating at once the guidelines discussed in the last two years between the Ministry of Mines and Energy, the Ministry of Finance, the Civil House, and the National Agency of Petroleum, Natural Gas and Biofuels.<\/p>\n\n\n\n<p>In July 2026, signals from the Ministry of Mines and Energy indicated that the publication was in its final stages. As of the writing of this article, the text had not yet been confirmed in the Official Gazette, but the proximity of the symbolic date of August 2nd reinforces the expectation that the decree will be issued as a complementary milestone to the law's anniversary.<\/p>\n\n\n\n<div style=\"height:50px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\">What to watch out for going forward<\/h3>\n\n\n\n<p>For companies that rely on legal certainty to make investment decisions, three signs are worth monitoring in the coming months:<\/p>\n\n\n\n<ul style=\"line-height:1.8\" class=\"wp-block-list\">\n<li>The effective publication of the decree and the detailing of the eligibility criteria for Rehidro and PHBC.<\/li>\n\n\n\n<li>The design for the first auction for access to incentives, mentioned by representatives of the Treasury as a goal for 2026.<\/li>\n\n\n\n<li>The specific regulations from the ANP (National Agency of Petroleum, Natural Gas and Biofuels) regarding natural hydrogen should open a new exploration front in the country.<\/li>\n<\/ul>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>Two years after its enactment, Brazil now has a legal framework recognized internationally as a competitive advantage. The final step is needed to transform this framework into clear operational rules that allow companies to turn memoranda of understanding into operational industrial
